By Resolution no. 19602 of 4 May 2016, Consob established the Financial Disputes Arbitrator (Arbitro per le controversie finanziarie, hereinafter the "Arbitrator") and adopted the Implementing Regulation of Article 2, paragraphs 5-bis and 5-ter, of Legislative Decree no. 179 of 8 October 2007, which set out the procedures for the out-of-court resolution of disputes before the Arbitrator and identified the criteria for the composition of its decision-making body (hereinafter the "Regulation").
The Resolution also entrusts Consob with the task of adopting the provisions implementing the Regulation, governing the organisation and functioning of the Arbitrator and also determining the date on which it will begin operating, and lays down, among other things, transitional and final provisions to allow the "replacement" of the Conciliation and Arbitration Chamber (Camera di Conciliazione e Arbitrato) with the Arbitrator.
